Workshop Terms & Conditions

  1. Authority to Carry Out Work

By delivering a motorcycle to us, or engaging us to collect a motorcycle from you, you authorise us to carry out inspection, servicing, repairs, fabrication, diagnostics, and associated work as requested or reasonably required to complete the job. You agree to pay all charges incurred.

  1. Quotes and Payment
  • Quotes are estimates unless stated otherwise.
  • Payment in full is required before the motorcycle is released, unless otherwise agreed in writing.
  • We reserve the right to request part or full payment in advance.
  1. Completion and Collection
  • A motorcycle is deemed complete when:
    • the agreed work has been finished; or
    • we notify you that the motorcycle is ready for collection; or
    • we request collection for any reason (including inability to proceed due to lack of instructions, parts, or documentation).

Notification may be given by phone, text message, email, or other reasonable means.

  1. Storage Fees
  • No storage fees apply for the first 3 calendar days after we notify you of completion, make a request to collect or for further information or instructions from you.
  • After this period, storage fees of $30.00 NZD per day (including GST) will apply.
  • Storage fees accrue daily and must be paid in addition to all outstanding work charges before release of the motorcycle.
  • Storage fees continue to accrue until the motorcycle is collected.
  1. Repairer’s / Seller’s Lien

We claim a repairer’s lien over any motorcycle worked on for all unpaid amounts, including:

  • labour,
  • parts,
  • subcontracted services,
  • storage fees,
  • and any other costs incurred.

This means we are legally entitled to retain possession of the motorcycle until all outstanding amounts are paid in full, in accordance with the Contract and Commercial Law Act 2017 and common law.

 

  1. Uncollected Motorcycles and Right of Sale

If payment is not made and the motorcycle is not collected:

  • We may, after the required statutory period and after serving notice in accordance with the Contract and Commercial Law Act 2017, sell the motorcycle by public auction or other lawful means.
  • The proceeds of sale may be applied to:
    • outstanding repair charges,
    • storage fees,
    • costs of sale (including advertising and auction fees).
  • Any surplus remaining after costs are recovered will be dealt with in accordance with the CCLA.
  • If sale proceeds do not cover the full debt, you remain liable for the balance.
  1. Customer Responsibility

You are responsible for:

  • Providing accurate contact details and keeping them up to date.
  • Responding to reasonable attempts to contact you.
  • Ensuring you hold any required licence or authority relevant to the motorcycle.

Failure to respond does not prevent storage fees accruing or enforcement of our lien rights.

 

  1. Risk and Insurance

Motorcycles are stored at the owner’s risk. We are not responsible for loss or damage beyond what is required by law, except where caused by our negligence. We recommend customers maintain their own insurance.

 

  1. Governing Law

These Terms & Conditions are governed by the laws of New Zealand.

Online Sales

Experience Motorcycles recognises the high importance of privacy and security to your Internet shopping experience. We have taken extensive measures to ensure high processing speed within an extremely secure online environment.

Security

Security is one of our highest priorities. Experience Motorcycles uses DPS (Direct payment Solutions) technology for online trading for your protection. Important information that you enter such as credit card details are encrypted and transacted immediately with the credit card supplier for increased web site security.

Credit Card Security

When you have entered your purchase requirements, your credit card details are entered via the extremely secure DPS web page. This enables high security and the minimum delay for your order. For Credit Cards not issued in New Zealand, additional checking may be required.

What is the Cardholder Verification Value (CVV2)?

CVV2 mandate requires all electronic commerce merchants to check CVV2 (Cardholder Verification Value) and acquirers to process CVV2 response codes correctly. The growth of the internet retailer sector means that an increasing number of merchants are now processing transactions in situations where the card and cardholder are not present and fraud may be difficult to detect. Basic card acceptance and fraud control procedures include the merchant asking for the CVV2.

CVV2 is a unique three-digit code that appears on the signature panel of all Visa and MasterCard cards and is used to confirm the validity of the card during card-not-present sales. Card-not-present merchants ask customers for the CVV2 as part of the order taking process and submit it for verification with other authorization information. The issuer will check the CVV2 and send a result (“match” or “no match”) along with the authorization decision. The CVV2 result enables the merchant to make a more informed decision regarding completing the transaction.

Locating your Cardholder Verification Value (CVV2)

For Visa and Mastercard: The CVV2 is the 3 digit number at the end of the 16 digit printed card number, located on the back of the card. In some cases you may see only the last 4 digits of your card number with the additional 3 digit CVV2 following. For Amex: The CVV2 is the 4 digit number printed above the ending digits of the embossed (raised) card number on the front of the card.

If you have difficulty locating your card identification code, you may wish to ask your credit card company for assistance.

Secure Process

As part of the engine used by Experience Motorcycles, there are secure processes built in. Specifically our engine ensures:

  • Every purchase has a unique number.
  • Every purchase is logged in a robust, secure database.
  • No credit card details are included in emailed order details.
  • Confirmation emails are sent to you the customer.

Currency

All prices shown on this website are quoted in New Zealand dollars

Incorrect Size Ordered

Experience Motorcycles will exchange goods that do not fit and will supply an alternative size. If an alternative size is not available, you will be offered an alternative style in the correct size. If you do not want the alternative style your order will be refunded. Return freight costs for the original order are your responsibility so please be sure to select sizes carefully. A restocking charge of 20% will apply to all returns.
